On June 16 at the Tokyo Metropolitan Assembly, the amendment of the ordinance for youth affairs was rejected due to the opposition by the Democratic Party. The DPJ was against the proposed ordinance that cartoons where hideous child pornography are written cannot be sold to the children.

I am a member of the Office for Youth Affairs and Public Safety which submitted the policy report, which is the original of this proposed ordinance. As a draft member, I wrote a draft of the report on the part of this amendment. I believed that this must be regarded perfectly normal not to sell the ugly child pornography to the children. I never even dreamed that it would be opposed. It was not saying not to write or not to sell to the adults. I even imagined that it would be criticized as not enough regulated.
In the world, for the first place, there are not a few countries that ban the sales and possession of cartoons with child pornography description. In the United States and in Canada, a man who possessed the child porno animation made in Japan was convicted. Last year, Japan was recommended to regulate animations and cartoons by the UN Convention on the Elimination of All Forms of Discrimination against Women. Therefore, the proposed amendment was very loose compared to the world standard, which should be considered from the world that it would be too late to regulate in such a low level… However, the DPJ was against even with such an amendment.

For this draft, cartoonists and printing industry were against, who are doing business with writing child pornography and who makes profit out of such cartoons by making books. Are they thinking that even their own children can have a freedom to buy and read such cartoons? I do not think so. They opposed because it was related to their profit. But it is a serious problem in terms of individual ethics, corporate compliance and the social responsibility. Especially in the world, such printing companies would lose their trust in the society and even would not be able to survive in such countries strict to child pornography.

What is more surprising is the DPJ’s attitude. Where in the world does the party exist, who takes the side of cartoonists who write child pornography rather than protecting their children? I do not understand quite well the reason for their opposition even looking at their response at the Metropolitan Assembly. They say that the ordinance is not clearly defined, but if it is the case, they have to submit their own revision plan but they have not done that, while the Liberal Democratic Party & New Komeito submitted their own. Under such circumstances, we cannot admit the reason of opposition is its loose definition. We can only think they are against the spirit of the ordinance to begin with.

In politics, it is needless to say that they should not take actions while listening to the interested individuals only on one side. They should make decisions while thinking what the society should be, especially how to protect children in the society. For this amendment of the ordinance, so many parents and people who have sensible ethics including PTA related persons have clearly agreed. The DPJ is standing not for their side but for the side of cartoonists who are writing child pornography and printing companies who are selling to make their profit. It is the DPJ who is the friend for some people who are vehement to tell that it is free even to sell the child pornography to children.

What would happen to the children in Japan if we continue to entrust the DPJ with the administration? I doubt that the Japanese society might become the one which allows making children to be the sexual object more than ever. I heard from my friends from overseas and living in Japan saying “Unbelievable” or “Is the party who take side of child porno lovers in administration in Japan?” This is the situation that it refuses to listen even to the recommendation by the UN.

I mentioned in “Why are you doing that far, the DPJ administration?” in Nikkei Business Online on May 13, 17 and 19, 2010 how much their political attitudes and policies are exceeding and alarming. And we can say that their uncommonness comes to such an extreme with their taking the side of “cartoonists who write child pornography” rather than of the children. What would happen to our children under such DPJ administration? I am not the only one who has the anxiety and fear.

　東京都青少年条例の改正案が、6月16日都議会で民主党の反対により否決されました。民主党は「おぞましい児童ポルノを描いた漫画を子どもに売ってはならない」という条例案に反対したのです。
　わたしは、本条例案の元となった答申を提出した東京都青少年問題協議会の委員かつ起草委員として、本改正部分について答申の案を書きました。子どもにおぞましい児童ポルノの漫画を売らないようにしようというのは、当たり前中の当たり前で、反対されるなんて夢にも思いませんでした。別に、描いてはだめとか大人にも売ってはだめというものではありません。ゆるすぎる規制として非難を浴びるだろうなと思っておりました。海外では、そもそも児童ポルノを描いた漫画の販売・所持を禁止している国が少なくありません。アメリカとカナダでは日本製の児童ポルノアニメを持っていた男に対して有罪判決が出されています。昨年、日本は国連女子差別撤廃委員会からアニメや漫画を規制するよう勧告を受けています。世界から見れば極めてゆるい、日本は今頃何をしようとしているんだ「やれやれ」というレベルのものですが、それにすら民主党は反対したのです。
　この条例案に対しては、児童ポルノを描いて商売している漫画家やそれを本にして利益を得ている出版業界が反対しました。この人たちは自分の子どもがこのような漫画を買って読むことは自由だ、とでも考えているのでしょうか。決してそうではないと思います。経済的利益がからむと反対してしまうのでしょうが、それは個人の倫理観や企業のコンプライアンス、社会的責任の観点から極めて問題です。特にそんな出版会社は社会の信頼をなくすでしょうし、児童ポルノに厳しい海外ではこんな出版会社は存続できないのではないでしょうか。
さらに信じられないのは民主党の対応です。どこの世界に子どもを守るよりも児童ポルノを描く漫画家の側に立つ政党があるというのでしょうか。民主党の反対する理由は都議会の答弁を見てもよくわかりません。定義があいまいだというのであれば、自ら修正案を出すべきであるのにそれも行っていません。自民党公明党は修正案を出しているのにです。
これでは、定義があいまいだという理由であるとは認められず、そもそも趣旨に反対としか考えられません。
政治というものは、一方的な利害関係者の意見をきいて行うべきものでないことは言うまでもありません。相反する意見がある中で、社会としてどうあるべきか、特に子どもたちを社会がどう守っていくべきなのか、という観点から判断していくべきものでないでしょうか。この条例の改正案に対しては、PTA関係者を始め、多くの子どもを持つ親や常識的な倫理観を持つ人々ははっきりと意思表示をして賛成しています。民主党は、そういう方々よりも、児童ポルノを描く漫画家やそれを販売して儲ける出版会社の側に立っているのです。児童ポルノを子どもに売ることすら自由だ、自由だとまくし立てる一部の人々の味方なのです、民主党は。
こんな民主党に政権を委ね続ければ、日本の子どもはどうなってしまうのでしょうか。日本は益々子どもを性の対象とすることを容認する社会となってしまうのではないでしょうか。日本に住む外国の知人からは「信じられない」、「日本は児童ポルノ愛好家の味方をする政党が政権をとっているのか」という言葉が寄せられました。国連からの勧告に対しても聞く耳持たない、という状況です。
民主党の政治姿勢や政策の異常さ・異様さについては、わたしは「そこまでやるか!民主党政権」(日経ビジネスオンライン2010年5月13日、17日、19日)で述べたところですが、民主党が本条例案を否決し、子どもより「児童ポルノを描く漫画家」の側に立ったことで、その異常さは極まれりといえるでしょう。こんな民主党に政権を任せて、子どもは一体どうなるのでしょうか。不安と恐怖を抱くのはわたしだけではないでしょう。

I released the urgent appeal with other lawyers on March 31 this year to encourage each party to ban the simple possession of child pornography while revising the anti-child pornography law during this Diet session. To the Democratic Party, I saw Mr. Hidaka, one of the deputy secretary-generals on April 6 to request for the law amendment. He told me that he would consider on this matter but has not made any actions. I feel that the most of the Diet members of the DPJ are against the amendment of the law. Their position on this matter has not changed or even becomes worse.

On the amendment submitted by the DPJ last year, they not only allowed the simple possession as it is now but also narrowed the definition of child pornography than the present law. According to that, abused images such as binding the unclothed child without particularly emphasizing genitals are regarded outside of the regulated child pornography. This is clearly retrogressive. This is the revision only to please cruel child porno lovers. And the person who took the central role of this revision was Yukio Edano, the present DPJ Secretary General.

According to the opinion poll by the Cabinet Office, 90% of the people agree to ban the simple possession. The LDP and the New Komeito agree as well. So once the DPJ agrees, necessary law amendment realizes. But the DPJ maintains the position to oppose the regulation. To oppose the proposal for the revision to ban the simple possession is, as a result, to approve the behavior to enjoy child pornography. It is unbelievable that the party in power, who organizes the government, develops such standpoint. Unfortunately, Japanese media does not voice the doubts on the DPJ’s reaction on this matter. I think the Japanese media’s bizarre silence and the lack of interest should be also called into question.

The DPJ had been against the ban of the single possession of child pornography since the time that they were an opposition party. I thought that when they came to power, they would not insist such an irresponsible assertion. So I was certain that the ban of the single possession would be realized with the change of government. I was sure that the party in power who organizes the administration cannot neglect the horrible sexual abuse to the children. But I was too optimistic. They are still neglecting. I cannot believe, but this is the essential quality of the DPJ. They are stunningly cold-hearted to children.

わたしは他の弁護士有志とともに、本年3月31日、緊急アピールを発出し、各政党に対して、今国会での児童ポルノ禁止法を改正し児童ポルノの単純所持を禁止するよう働きかけました。民主党に対しては本年4月6日に副幹事長の一人である樋高議員に会い、法改正を行うよう要請しました。彼は検討すると言いましたが、それ以降、何のアクションも起こされていません。 民主党の国会議員の多くは法改正に反対であると感じております。民主党のこの問題に関する見解は変わっていないか、むしろ悪化しています。

民主党が昨年国会に提出した児童ポルノ禁止法の改正案では、単純所持をそのまま認めるのみならず、児童ポルノの定義を現行法より狭くしており、それによると、性器を殊更に強調せずに幼児を裸にして縛るなどの虐待画像が、規制される児童ポルノの対象から外れることとなります。明らかな後退です。残虐な児童ポルノ愛好者が喜ぶだけの改正です。民主党でこの改正案のとりまとめに当たった中心的な議員は枝野幸男議員です。そのような人物が今の民主党の幹事長なのです。

内閣府の世論調査によると90％の国民は単純所持を禁止する考えに賛成しています。自民党と公明党も賛成しています。民主党が賛成すれば、必要な法改正は実現するのです。しかし、民主党は規制に反対する姿勢を維持しています。単純所持を禁止する法改正の提案に反対することは、結果として児童ポルノを楽しむ行為を容認することです。政府を構成する与党がこのような見解を打ち出していることは信じがたいことです。残念ながら、日本のメディアは、この問題に対する民主党の反応に疑問を表明していません。私は、日本メディアの奇妙な静けさと無関心も問われるべきだと思います。

　民主党は野党時代から児童ポルノの単純所持の禁止に反対していましたが、わたしは、さすがに政権党になれば、野党当時のような無責任な主張はできないだろうと思っており、政権交代により単純所持の禁止は実現するだろうと確信しておりました。いくらなんでも、政府を構成する政権党が子どもに対するすさまじい性的虐待を放置することはないだろうと思っておりましたが、甘かったです。放置し続けています。信じられないことですが、これが民主党の本質なのです。子どもに冷淡極まりないのです。
